Terms and Conditions

These Terms and Conditions (“Agreement”) govern the provision of lawn care and landscaping services (“Services”) by Big Diggs Landscaping and Lawn Care LLC (“Company”, “we”, or “us”) to the customer (“Client” or “you”). By engaging our Services, you agree to the following:

1. Scope of Work

Services provided will be as described in your estimate or service agreement. Any changes to the scope must be agreed upon in writing.

2. Scheduling & Access

The Client agrees to provide reasonable access to the property during scheduled service times. If gates are locked or access is otherwise restricted at the time of service, the visit may be skipped and rescheduled at the Company’s discretion.

If the Client has pets and/or children, all outdoor areas must be cleared of pet waste, toys, and other obstructions prior to each scheduled service. This ensures the safety of our staff and protects equipment from damage.

  • If pet waste and/or toys are not removed, a $10 cleanup fee will be applied per visit.

  • Repeated obstructions may result in service delays or cancellation.

The Company is not liable for delays caused by inclement weather, restricted access, or unprepared service areas.

3. Payment Terms

  • All invoices are due by the end of the month in which services are rendered (“Net EOM”).

  • A late payment fee of 1.0% per month (12% annually) will apply to any past due balances not paid within five (5) days of the due date.

  • Continued non-payment may result in suspension or termination of services and may be subject to collections.

4. Paperless Billing

We offer a paperless billing option via email. By providing your email address, you consent to receive invoices and payment reminders electronically. It is your responsibility to keep your contact information up to date.

5. Cancellations

Scheduled services may be canceled with at least 24 hours’ notice. Missed or same-day cancellations may be subject to a service fee.

6. Liability

We are insured and take reasonable care in all work performed. However, we are not liable for:

  • Pre-existing damage to property or landscaping.

  • Damage resulting from unreported underground structures or hazards.

  • Delays caused by weather or conditions outside our control.

7. Termination

Either party may terminate this agreement with written notice. Outstanding balances remain due upon termination.

8. Governing Law

This Agreement shall be governed by the laws of the state of Colorado.

9. Entire Agreement

These Terms constitute the entire agreement unless superseded by a written contract signed by both parties.
